There is a belief it is likely that the court, Paul Magnuson, will decide not to send both parties back to the table for negotiations. When Magnuson accepted the Madden 23 coins settlement plan in April, he stated:

"It is worth repeating: the plaintiffs who brought this suit and now opposed the settlement rode through the courtroom under the banner of helping their disadvantaged brethren and those who played for the N.F.L. but were today in debt and often being afflicted by injuries or illness directly related to their playing days. It's a sign of insincerity for the same plaintiffs to complain as if they were children who are not allowed dessert that the settlement will not provide enough benefits to the people who filed the suit."

Participants who do not opt out of the settlement may then file personal lawsuits to sue the NFL. They may be more enticed to file a lawsuit due to recent changes in the O'Bannon. NCAA case, too which is happening now that former college athletes are suing over the use of their image to play video games.

In July in July, in July, the Ninth Circuit threw out an appeal filed by video game maker EA Sports. The court rejected the argument of EA that the likeness of players were protected under the First Amendment and it will let the case proceed.

The Dryer plaintiffs are monitoring that case with great interest. They're also watching a different lawsuit that was filed by thousands of ex- Madden NFL 23 athletes, over concussions.

"I believe there is an association in the air in this case," Dryer said of the two instances. "The Madden NFL 23 is extremely shrewd and naive at the issue of concussions.

"There's an innate belief [in Madden NFL 23] Madden NFL 23of "we want it, and we're going to accept that.' There's an air of arrogance there."

Dryer is hopeful that something will work out, so that he and his former teammates can reach a deal with Madden NFL 23 which will pay them directly for the use of their image and leave them with the rights to it.

"I have a lot of transactions based on my appearance as actor and producer," Dryer said. "My image is the basis of my business. It's my identity. Everyone has a brand and 
cheapest mut coins each person is entitled to steer their brand in the direction that they prefer.
